Legal Counsel - Compliance

Noosa Heads / Sydney

We are seeking an experienced, knowledgeable Legal Counsel – Compliance to join our growing team at Lanyana Financial Group. The ideal candidate will have a degree in Law, Accounting, Finance or Economics with previous experience as a Lawyer, Accountant or experience in AFSA + ASIC departments. This is the perfect role for someone who has a deep understanding of Financial Services Legislation, Bankruptcy Legislation, Corporate Liquidations, the Privacy Act, AFSA and ASIC Regulations.

Key Responsibilities:

  • Ensuring the business is working in accordance with the law
  • Researching and assessing risk, in particular corporate governance, privacy laws, consumer law and debt management industry issues. Be across legislative issues concerning Registered Debt Agreement Administrators + Bankruptcy Trustees + Corporate Liquidator responsibilities
  • Limiting company exposure in all agreements and ensure adherence to company policies;
  • Instruct and manage external legal advisers where required
  • Ensure our business teams are aware of any regulatory and compliance requirements for their team with regular training and:
    • Spot audits of our lending files to ensure compliance with our ACL requirements
    • Spot audits of all customer call recordings to ensure compliance with regulatory guidelines
    • Spot checks of marketing and advertising materials to ensure in line with AFSA and ASIC guidelines
  • Review and update the compliance policies and procedures in accordance with regulatory guidelines
  • A focus on continuous compliance policies and procedures improvement
  • Resolve high level customer complaints lodged with AFCA
  • Managing all IP, patents, business names and trademarks
  • Attending to labor and employment matters
  • Review and access adequacy of all business insurances
  • Collaborating with key stakeholders including reporting to the board

Qualifications, skills & experience:

  • Required degree in Law, Accounting, Finance or Economics
  • Practice as a Lawyer, Accountant or experience in AFSA + ASIC departments, 5 + years’ experience
  • Deep understanding of Financial Services Legislation, Bankruptcy Legislation, Corporate Liquidations, Privacy Act, AFSA and ASIC Regulations
  • Strong analytical skills with ability to problem solving and obtain high attention to detail
  • Ability to build strong and collaborative working relationships
  • Outstanding communications skills (written and verbal)

Debt Negotiator

Gold Coast - Robina

We are seeking highly experienced debt negotiator to negotiate payment arrangements and debt settlements with creditors to ensure we get the best possible outcome for our clients. The ideal candidate will have worked in a similar negotiation role or have worked on the creditor side in a Financial Hardship or Collections Team and understand the thought process from the creditors perspective regarding their acceptance of proposals and Financial Hardship.

Key Responsibilities:

  • Passionate attitude towards achieving positive outcome for clients.
  • Build and maintain existing relationships with internal and external stakeholders but predominantly the hardship teams within the major banks, debt purchasing companies and other creditors.
  • Manage client expectations through honest feedback whilst working hard to get our clients a great outcome.
  • Complying with company policies and adhering to government legislation.

Qualifications, skills & experience:

  • Certificate IV in Finance Services or Tertiary qualifications in accounts or finance will be desirable, but not essential
  • Experience in Part IX Debt Agreements and Informal Debt Agreements will be beneficial
  • Knowledge in insolvency, finance or accounting will be essential
  • Persuasive negotiator and excellent communicator with the ability to overcome objections.
  • Quick thinker and able to use information at hand to quickly resolve issues.
  • Results oriented.
  • Staying on top of things is your strength, you can manage pressure like a pro.
  • Great time management skills and efficient typing speed.
  • Ability to work autonomously and contribute in a team environment.
  • Previous customer service, collection experience in the banking or insurance industry will be advantageous.
